City police say a Kingston man was drunk on the night of Aug. 1 when he struck a pedestrian crossing Broadway, leaving him with devastating physical injuries. Justin A. Grieco, 35, was arrested Tuesday along with Katie A. Potter, 39, who is charged with evidence tampering and insurance fraud in connection with the hit-and-run.

On the night of Saturday, Aug. 1 police say Grieco was behind the wheel of a pickup truck driving on Broadway when he struck the unidentified victim who was crossing Broadway near Liberty Street. Video of the aftermath of the collision shows a shopping cart belonging to the victim with a twisted frame while a trail of garbage and shopping bags stretch about 50 feet down Broadway.

The victim was transported to HealthAlliance Hospital and was eventually transferred to a long-term ICU where he remains in a coma. The intersection where the collision occurred is covered by police surveillance cameras and at least one privately owned camera at a nearby business which likely captured the incident.

Police say Grieco and Potter were arrested on a warrant from county court on Wednesday and held in the Ulster County Jail overnight pending arraignment Thursday morning. According to the jail’s inmate tracker, Grieco remained in custody Thursday afternoon. Grieco is charged with felony assault and vehicular assault in the second degree and misdemeanor counts of operating a motor vehicle while under the influence of alcohol, tampering with physical evidence, leaving the scene of a personal injury accident, reckless driving and aggravated unlicensed operation of a motor vehicle. Potter is charged with felony counts of tampering with physical evidence, falsifying business records and insurance fraud.

The KPD investigation was assisted by the Ulster County Sheriff’s Office, the Ulster County Crash Reconstruction Unit and the District Attorney’s investigative team. Kingston police also thanked the public for their assistance in the investigation.
